4. SMS/Text Messaging Program

Program Name: Neolé SMS Notifications

What we send: If you opt in to receive text messages from Neolé, you may receive two types of messages depending on the consent you provide:

Appointment-related (transactional) messages: These include appointment confirmations, appointment reminders, rescheduling notifications, pre-visit preparation instructions, and general office announcements related to your care at our center.

Examples of transactional messages include:

"Neolé: Reminder — your neurofeedback session is scheduled for Tuesday, March 25 at 10:00 AM. Please arrive 15 minutes early. Reply STOP to opt out."

"Neolé: Your appointment on Thursday, April 3 has been rescheduled to Friday, April 4 at 2:00 PM. Call 431-450-4138 with questions. Reply STOP to opt out."

"Neolé: Your biofeedback consultation is confirmed for Monday, April 14 at 9:30 AM at our Toronto office. Please complete your intake forms before arriving. Reply STOP to opt out."

"Neolé: Our office will be closed on Friday, April 25 for a staff training day. If you have an appointment scheduled, please call 431-450-4138 to reschedule. Reply STOP to opt out."

Promotional messages: These include special offers, service updates, brain health tips, and information about new services or programs available at our center.

Examples of promotional messages include:

"Neolé: This month, enjoy a complimentary initial consultation when you refer a friend. Call 431-450-4138 to learn more. Reply STOP to opt out."

How you opt in: You may opt in to our SMS program by checking the SMS consent checkbox on our website booking form at https://toronto.neurofeedbacksolutions.com/contact-us, completing a paper or electronic intake form that includes SMS consent, or verbally requesting text message communications during a phone call or office visit. The booking form includes separate, unchecked-by-default consent checkboxes for (1) appointment-related SMS messages and (2) promotional SMS messages. You may opt in to either or both types independently. Your consent to receive text messages is entirely voluntary. Providing your phone number and consenting to SMS is not required to book an appointment or receive services from Neolé.

Message frequency: Message frequency varies based on your appointment schedule and the types of messages you have opted in to receive. You may receive up to 8 messages per month.

Message and data rates: Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

How to opt out: You can cancel the SMS service at any time. Just text "STOP" to the short code or phone number from which you received messages. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.

5. No Sharing of Mobile Information

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6. How We Share Your Information

We do not sell your personal information to third parties. We may share your information in the following limited circumstances:

Service providers: We may share information with trusted service providers who assist us in operating our business, such as appointment scheduling platforms, payment processors, and IT support providers. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

Neolé is committed to protecting your health information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA), the Personal Health Information Protection Act (PHIPA) of Ontario, and applicable federal and provincial privacy laws.

Important notice about SMS: Standard SMS and MMS text messages are not encrypted and are not a fully secure or confidential method of communication. There is a risk that text messages may be intercepted by, or accessible to, unauthorized third parties, including wireless carriers and other intermediaries.

What we will never include in text messages: Neolé will never include personal health information in text messages. This means we will never send your diagnosis, treatment details, neurofeedback session results, biofeedback reports, clinical records, test results, medications, or billing details via text message.

What our text messages may include: Our text messages are limited to appointment date and time confirmations, appointment reminders, rescheduling notifications, general pre-visit instructions (such as "please arrive 15 minutes early"), general office announcements, and promotional content such as special offers, brain health tips, and information about new services.

Your rights: You have the right to request that we communicate with you through an alternative method or at an alternative location. If you prefer not to receive text messages, you may opt out at any time by texting STOP, or by contacting our office to request an alternative communication method.

8. How We Protect Your Information

We implement reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, alteration, or disclosure. These safeguards include:

PHIPA compliance documentation is retained for the period required under applicable regulations.
