1. Agreement to Terms
By accessing the Neolé website at https://toronto.neurofeedbacksolutions.com or using any of our services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please do not use our website or services.
You must be at least 18 years of age to use this website and our services. By using our website, you represent and warrant that you are at least 18 years old. If you are under 18, you may only use our website with the involvement of a parent or legal guardian.
2. SMS/Text Messaging Terms
Neolé offers an SMS messaging program that sends two types of messages to clients who opt in:
Appointment-related (transactional) messages: These include appointment confirmations, appointment reminders, rescheduling notifications, pre-visit preparation instructions, and general office announcements.
Examples of transactional messages include:
"Neolé: Reminder — your neurofeedback session is scheduled for Tuesday, March 25 at 10:00 AM. Please arrive 15 minutes early. Reply STOP to opt out."
"Neolé: Your appointment on Thursday, April 3 has been rescheduled to Friday, April 4 at 2:00 PM. Call 431-450-4138 with questions. Reply STOP to opt out."
"Neolé: Your biofeedback consultation is confirmed for Monday, April 14 at 9:30 AM at our Toronto office. Please complete your intake forms before arriving. Reply STOP to opt out."
"Neolé: Our office will be closed on Friday, April 25 for a staff training day. If you have an appointment scheduled, please call 431-450-4138 to reschedule. Reply STOP to opt out."
Promotional messages: These include special offers, service updates, brain health tips, and information about new services or programs.
Examples of promotional messages include:
"Neolé: This month, enjoy a complimentary initial consultation when you refer a friend. Call 431-450-4138 to learn more. Reply STOP to opt out."
"Neolé: Start your brain health journey! Book a neurofeedback consultation this spring and receive a free assessment. Visit toronto.neurofeedbacksolutions.com or call 431-450-4138. Reply STOP to opt out."
"Neolé: Did you know? Neurofeedback training can support better sleep and focus. Learn about our programs at toronto.neurofeedbacksolutions.com or call 431-450-4138. Reply STOP to opt out."
"Neolé: New service alert — ask us about our biofeedback sessions for stress management and peak performance. Call 431-450-4138 to schedule your introductory consultation. Reply STOP to opt out."
By opting in to the Neolé SMS program, you consent to receive text messages from Neolé at the phone number you provide. You may opt in by checking the SMS consent checkbox on our booking form at https://toronto.neurofeedbacksolutions.com/contact-us, completing an intake form that includes SMS consent, or verbally requesting text message communications. The booking form includes separate, unchecked-by-default consent checkboxes for appointment-related messages and promotional messages. You may opt in to either or both types independently.
You can cancel the SMS service at any time. Just text "STOP" to the short code or phone number from which you received messages. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or you can get help directly at [email protected] or 431-450-4138.
Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your appointment schedule and the types of messages you have opted in to receive. You may receive up to 8 messages per month. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Carriers are not liable for delayed or undelivered messages.
Consent to receive text messages is not a condition of booking an appointment or receiving services from Neolé.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

3. Appointment Scheduling and Cancellations
Booking a consultation through our website or by phone constitutes a request for services and does not guarantee appointment availability. Neolé reserves the right to reschedule or cancel appointments due to provider availability, emergencies, or other circumstances.

4. Healthcare Disclaimer
The content on our website, including text, graphics, and other materials, is provided for general informational purposes only. Neolé is not responsible for any charges from your wireless carrier related to SMS messaging, including message and data rates.

You agree to indemnify, defend, and hold harmless Neolé Inc., d/b/a Neolé, and its officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your violation of these Terms and Conditions or your misuse of our website or services.
9. Changes to These Terms
Neolé reserves the right to modify these Terms and Conditions at any time. We will post the updated terms on this page with a revised "Last Updated" date. Your continued use of our website or services after any changes constitutes your acceptance of the revised terms.
10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. For disputes arising from SMS messaging services directed at US recipients, applicable US federal and state telecommunications regulations shall also apply. Any disputes arising under these terms shall be resolved in the courts of Toronto, Ontario, Canada.

If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
